These Terms & Conditions govern the use of the website uniqueplaylists.com and the use of our services. By using our website and/or submitting music, you agree to these terms.

These Terms & Conditions apply to all services offered through the website uniqueplaylists.com, in particular the submission of music for playlist reviews.
2. Service Description
Unique Playlists offers a music curation service. Artists can submit songs for review. Our team reviews submitted songs and decides based on artistic and editorial criteria whether a song will be added to one of our playlists.
In addition, Unique Playlists may offer a Premium Pitch Service on SubmitHub. This service can include song readiness review, sound and production feedback, pitch strategy, SubmitHub profile preparation, curator targeting, campaign execution with SubmitHub credits, and forwarding of available SubmitHub results to the client.
3. Submission Fee and Payment Terms
3.1 Fee Structure
A Curation Fee is charged for submitting a song. This fee compensates our team exclusively for the time and effort spent listening to, analyzing, and reviewing your submitted material.
3.2 No Placement Guarantee
Payment of the submission fee does not guarantee that your song will be added to a playlist or shared on our networks. The decision to include a track is based solely on artistic merit and editorial discretion.
3.3 Payment Processing
Payments are processed securely via Stripe, Inc. We do not store credit card details on our servers. All payment data is encrypted and processed directly by Stripe.
3.4 Premium Pitch Service Payment Terms
Premium Pitch Service orders are paid in advance via Stripe. The fee covers professional review, strategy, preparation, campaign handling, communication, and, where included in the selected package, the use of SubmitHub credits for pitching.
If a Standard or Premium campaign is completed without using all planned SubmitHub credits, the unused credit portion may be partially refunded after completion. The refund applies only to unused SubmitHub credit value, not to the service, review, strategy, administration, or time already performed.
3.5 Delivery Times and Results
Song Readiness Reviews are usually delivered within 2 days. Standard and Premium pitch campaigns are usually completed within 5-7 days, depending on when all relevant SubmitHub responses and campaign results are available.
Available SubmitHub data, including curator responses, approvals, rejections, and relevant campaign results, will be forwarded to the client as transparently and accurately as possible.
4. Right of Withdrawal and Refunds
By clicking "Submit" and completing the payment, you expressly agree that we may begin performing the service (reviewing your track) immediately. Consequently, you lose your right of withdrawal once the service has commenced. A rejection constitutes a completed service.
This is in accordance with Art. 18 para. 2 lit. c of Swiss consumer law (Consumer Goods Act), according to which the right of withdrawal expires if the service has been fully performed with the express consent of the consumer before the consumer has exercised his right of withdrawal.
For the Premium Pitch Service, refunds are generally excluded once work has started. This includes listening, analysis, strategy, preparation, communication, or SubmitHub campaign execution. Partial refunds may only apply to unused SubmitHub credits as described above.
5. Liability
5.1 Disclaimer
We assume no liability for:
- Losses or damages resulting from the rejection of a song
- Technical problems or failures of the website or third-party services (e.g., Spotify, Stripe)
- Losses of streams, followers, or revenue
- Legal violations by submitted songs (copyrights, trademark rights, etc.)
5.2 User Liability
You guarantee that:
- You own the rights to the submitted song or are authorized to submit it
- The song does not violate third-party rights
- All provided information is correct
You are liable for all damages resulting from violations of these guarantees.
6. Copyright
By submitting a song, you do not transfer any copyrights to us. You retain all rights to your song. If your song is added to a playlist, you merely grant us permission to include and promote the song in the respective playlist.
7. Data Protection
The processing of your personal data is carried out in accordance with our Privacy Policy. By using our website, you consent to the processing of your data.
8. Changes to Terms & Conditions
We reserve the right to change these Terms & Conditions at any time. Changes will be published on this page. Continued use of our website after publication of changes constitutes your consent to the amended terms.
9. Dispute Resolution and Applicable Law
Applicable Law: Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction: For all disputes arising from or in connection with these Terms & Conditions, the court at the provider's seat (Bern, Switzerland) shall have jurisdiction, unless the user is a consumer and not resident in Switzerland, in which case the user's local court shall have jurisdiction.
Online Dispute Resolution: The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
10. Severability Clause
Should individual provisions of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
